Mid of 2007 the European community has started the count down to activate the long-term prepared REACh ordinance as the new European by-law for chemicals. The main principle of REACh is
“No Data – No Market” which means that the precondition for placing a substance in the market is the complete characterization including the ecotoxicological and toxicological data. REACh inverts also the responsibility: Now the industry (and not the authority) is responsible to evaluate the comprehensive set of needed data and to describe a safe use of a substance.
As a foreign company without an European legal office you can use European trading companies as the importer (if the company has registered the substances which you want to supply), but more freedom gives you the appointment of an “Only Representative“, which is a special legal construction under REACh.
